A Response To Her Recent Attack On Jonathan Friedrich

Ms Holland presumes she is the ”Queen Bee” of all community managers in the Las Vegas area.

First a few facts about Ms. Holland:

The column that she posts each week in the Review Journal SHE PAYS FOR. She is not a columnist working for the newspaper. If you observe near the very top of the page under the “Real Estate” banner the words “promotional section” are printed. This is another way of saying this is an advertisement!

Ms. Holland has built a successful business through the use of this advertisement tool.Ms. Holland, who is a licensed community manager number CAM.0001049-SUPR, has had numerous complaints filed against her with the Nevada Real Estate Division in the past. Ms. Holland makes a very nice living off the backs of people living in Homeowner Associations.

Ms. Holland’s unprovoked rabid attack on me in her paid column on September 27, 2014 for expressing my “global” view on the Nevada State Supreme Court’s decision only shows her myopic view of HOA life and her own financial well being.

What Ms. Holland fails to realize is the big picture that banks will be very cautious about lending in Nevada. This can translate into higher interest rates or refusal to lend at all!

As a Commissioner on the Common Interest-Community Commission I had a sworn duty to protect ALL of the people of this State and not just the special interest groups. This is what I did and continue to do.

Ms Holland, on the other hand, only has to look after her own special business interests. She is part of an ever growing and controlling industry that is threatening the very fabric of American life and liberty of its citizens.

To quote Ms. Holland “its about time we caught a break.” But it’s the homeowners who really need a break!

Homeowner associations have almost unlimited powers. When you purchase a home or Condo in an association you consent to be “ruled” by a group of individuals known as a “board.” This board decides what your monthly assessment is, how much will be spent on your behalf and on what, what color you can paint the exterior of your home, when you can open your garage door and for how long it can stay open, what plants and flowers you can plant. In short an HOA can and does control your life.

HOAs were created back in the 1960s to keep Blacks, Jews and Asians out of “private” communities. Is this the American way of life? I do not think so.

Oh, Ms. Holland I almost  forgot to mention all of the corruption, embezzlements of funds by board members and or the managers and kickbacks to managers all costing owners millions of dollars a year. Let us not forget the abuse and attacks  against owners who speak up and speak out against board members.

As a Commissioner I witnessed many of these acts first hand.

So Ms. Holland we the homeowners do need a “break”.

Ms. Holland, with her tunnel vision view of the world, owes me an apology. But I don’t expect one from her.

    If the banks stop loaning Ms. Holland will get the “break” she isn’t hoping for.

    When owners can’t sell and walk away from HOAs and condos there won’t be anything to manage. Abandoned properties rarely have a need for a property manager.

    Sometimes newspapers make mistakes by selling space to ignorant people. This could be one of those examples.

    Itt is amazing that they push such a terrible case and there is little doubt that it will result in the banks refusing to loan when they risk an organization like home owners association can step up and steal the house which is the security on the loan. The home owners will still be responsible for the mortgage but there is almost no chance the bank will ever get the person to continue to pay. The banks fully understand that jury nullification could come into play making a legal recourse difficult or impossible. The HOAs love to steal the homes but they will have to get the home owners out. I suspect there will not be much of the house left since until the homeowner leaves they are free to do anything they want to the property. Of course the HOA can issue a $50 fine for the removal of the walls and supporting beams.

    This makes me laugh.

    Granted the HOA boards of directors have found most HOA members to be apathetic, brain dead, or too afraid to speak up and expose them.

    The people I have known who served on the board of directors of a banking institution are way too intelligent to fall into the trap of losing money to some HOA goofballs that think they can scam them out of a mortgage. Nope. Won’t happen. The banks will stop lending on HOA properties, if they haven’t already.

    Some banks are already digging deeper before loaning on HOA properties. I filed a lawsuit to see the financial records in Quivira Falls. One of my neighbors called me screaming and demanding I drop the lawsuit because I was keeping her from selling her townhouse. She was making no sense in her claims so I called her Realtor. She explained that the lender for the buyer did their due diligence by contacting the county courthouse to inquire about any lawsuits involving the HOA. Mine was pending so they paid the per page fee and acquired the documents on the case. With that information they denied the loan to the buyer. The buyer saw red flags and decided not to pursue another lender but to walk away from purchasing in Quivira Falls. SMART LADY!!!

    Some banks may be hungry for loans and become reckless, but others proceed with caution. Ultimately, they will all become wise to the risks of loaning in HOAs. With that the buyers will become wise, too.

    In time, these HOA scam artists are going to learn that nobody packed their parachute.

    Get your facts straight. I DO NOT PAY THE REVIEW JOURNAL TO PUBLISH MY ARTICLES FOR THE Q & A SECTION OF THE REAL ESTATE SECTION. THEY APPROACHED ME IN 1996 TO WRITE A COLUMN OF QUESTIONS AND ANSWERS. SECOND, FOR THE RECORD, I DO NOT RECEIVE ANY COMPENSATION FROM THE RJ IN WRITING THE COLUMN. I SPEND MANY PERSONAL HOURS EACH WEEK ANSWERING LETTERS. I CAN TELL YOU THAT I HAVE RECEIVED MULTIPLE THANK YOUS FROM THE READERS WHO I HAVE HELPED OVER THE PAST 18 YEARS IN RESOLVING THEIR HOA PROBLEMS WITHOUT THEM GOING TO THE DIVISION AND WITHOUT THEM PAYING ANY ATTORNEY FEES.

    IT IS FACTUALLY INCORRECT THAT I HAVE MANY COMPLAINTS FILED AGAINST ME OR MY COMPANY- EITHER AT THE NEVADA REAL ESTATE COMMISSION OR THE CICCH COMMISSION. IF YOU WANT THE FACTS, CONTACT SHAREN JACKSON, THE OMBUDSMAN AND NOT POLITICAL RHETORIC.

    First of all it appears that you are the paid individual that creates and then submits false inaccurate reports. It is a shameful way you have to resort to such just to get an article printed and attach your claim to fame, such as it is. HAHA. I hope that Barbara Holland’s attorney submits a request to you in writing to provide proof of what you claim to be as fact, once it is proven you have no evidence I would expect you to print a retraction of all false statements, as the public has the right to know the truth. It appears you possibly are impaired in such a way that makes you incapable of seeking or writing the truth. You may want to consider another career path.

      Just a friendly tip here.

      One of the easiest ways to admit guilt or responsibility for something is to start screaming. (ALL CAPS) The other is to have your buddy post threats of “lawyering up” and demanding retractions.

      It’s been my experience that HOA property managers can dish out abuse but they sure have thin skin when the spotlight is turned on them.

    I ran across this blog post in search of contact information for Ms. Holland. My home was sold out from under me in 2012, even though the “collection agency” aka “lawyers” had made a payment arrangement with me. they neither followed due process, nor did they honor their agreement. As far as the Ombudsman’s office, I’m filing complaints against them as well for negligence and dereliction of duty. Their duty is to the homeowner not their creepy legislative and judicial friends. I asked for a copy of records of my original ADR (I already have a copy, I wanted to find out how long they keep them) and they flat out told me that all the documents are theirs to keep and that they had probably destroyed them anyhow. In so many words, they told me they wouldn’t help me (BIG surprise). My advice for HOA and community managers? Save up some money because soon you are going to find yourselves without a job and a lot of attorney’s fees to pay. We the people have spoken, and we’re coming to get back what you’ve stolen.
