An excellent article appeared in the Denver Post on September 6th. It’s called “The Dark Side of HOAs.” It’s must-reading for anyone concerned about the current HOA mess. I’ve linked it below.
What Mr. Martinez failed to note is that for the 8,287 HOAs which are currently registered in Colorado, only 478 actual complaints were made and none of those complaints were investigated to determine if they are valid.
While it’s fair to say that some boards of HOAs are on power trips, act inappropriately and should be removed; it is also fair to say that the vast majority of boards, managers and management companies are acting with the best of intentions and in the best interests of the communities they serve.
I wouldn’t use the term “the vast majority of boards.” I might use the term, “many boards.” Something this attorney did not mention is that the Colorado HOA Board does not have ANY enforcement or investigative power. The only thing it’s really able to do is provide general information to consumers, and to charge each HOA $10 for annual registration. And as you and I both know, HOA lawyers will say and do just about anything to protect their income stream.
