“HOA constitutionality will cause the collapse of CAI”
Such statements made in court filings are astonishing! It is a complete refutation and about face to CAI’s propaganda material made for public consumption. It repudiates our democratic system of government and the US Constitution!
What would cause CAI to argue such statements without merit before a state supreme court? Maybe because CAI knows that if HOA constitutionality is accepted and HOAs are seen as state actors or made to become state entities, it would no longer control and dominate the industry. All would be lost!
HOAs would not be lost as CAI has argued from time to time. CAI would be lost! It would have to rethink its public policies, its Best Practices, its training seminars, etc. It would need to include such courses, which are not and never have been in the CAI vocabulary, understanding the Constitution and Bill of Rights, good local government, best city management practices, etc.
What people may not realize is that the physical structure of HOAs will not disappear or suffer from rejoining our Constitutional Republic. On the contrary, Physically and socially, housing developments will continue to devolve into chaos, deterioration, blight, and lawlessness if CAI’s hybrid corporate/mini-government policy is allowed to persist, thanks to our misguided or crony-influenced Legislators.
The HOA governance structure, as we know it, has proven itself to be unworkable and harmful. It’s time to return control of private property and subdivisions to the people, by way of publicly elected government and Constitutional principles of equal justice. Developers, real estate investors, and management companies – and their attorneys – should not be permitted to control “communities” and the people who dwell within.
May the NJ Supreme Court lead the way to restoration and preservation of the American Dream for 65 Million HOA residents!
The bigger problem is why do we have and have had legislators who believe them and corrupt judges, attorneys and HOA board members, in kangaroo courts stripping homeowners of their finances and property? Denying innocent victims of these HOA syndicates protections under the laws, due process, and their rights, even when the criminality being inflicted and carried out on the innocent HOA homeowner is proven. This is a disgrace in America and especially in Monroe County, Pennsylvania!
Why not ask NBC to investigate the HOA abuses, lack of consumer protections, legislative initiatives and range of HOA criminality, including property thefts!
Please consider telling NBC your HOA ordeal, or HOA horror and why they need to investigate the range of HOA abuses and criminality, including the property thefts! Making innocent people, families homeless, out of greed driven, or malicious self serving agendas in dysfunctional states with kangaroo court rooms and no homeowner protections across America.

For our lifetime property values for the most part increased. The great lie was the house belongs to the owner. My father always stated the homeowner only rents from the local government. HOA have been a new level of ownership and the new system has created a nightmare of greedy individual who used the new HOA for personal gain. They had no controls and like the traffic courts a method to extract money from people who purchases HOA controlled property.
The increase in property price to a very large degree was re pricing due to inflation. A house that was purchased for $25,000 in 1965 and sold in 2014 for $125,000 sold for a lose in the purchase value of the dollar. Example a fine auto could be purchased for $3,000 in 1965 and a fine auto is $28,000 in 2014. In 1965 sales tax was not common so in2014 you would pay a tax on the item of about $1600. Today most believe that home buying will even have any increase and a lot believe realest is a bad investment
HOA now fact owners who understand the HOA often are the reason for not being able to sell. A few big gains for crooked individual of the HOA have been wildly published.
The one reform most needed is the elimination of management companies which are employed. In our HOA they farmed it to a management company owned by one of the directors. Why is this bad? They tack $10 to every credit card. This turns a fifty dollar fine in sixty. They inspect the property four times a week.
Any HOA member who is unable to do the work of the HOA is free to quit. They were not drafted but ran in an election. There really is no work that needs outside people unless professional certificates are required by law or custom.
The HOA can hire a bank to accept deposits.
Eliminate the ability to loot and you will get a much better system. This is true un government. Eliminate the money and the snakes will leave
