Florida Pro-Se Homeowner Strikes Out…One, Two, Three Lawyers!

Forget lawyering-up for Florida homeowner David Acosta.  He took the task of getting an injunction against Alaqua HOA on himself and Judge Marlene Alva ruled in his favor. Yep, the injunction against this maniac HOA bunch is on the record!
 
Acosta’s dues were in arrears so the HOA decided the best way to collect was to prohibit his family and friends from visiting him by calling the sheriff to have them arrested as trespassers!
 
David out-smarted three different law firms representing this Homeowners Association.  He got the judge to agree to let him pay his dues directly to the court  That fired up the HOA’s attorney who instructed the board to call a meeting and change the by-laws.  But Judge Alva ruled that meeting was illegal.
 
Acosta must have grown tired after swinging his bat at all these law firms.  He’s now hired an attorney and is suing for a settlement.  And I hope he gets a BIG one!  Six figures would be ideal.
 
Just for grins, he ought to sue the HOA attorney for malpractice, too.  And, David while you’re at it, go ahead and sue each board member for fiduciary failure!
 
Take em’ all down and send them off the field on a gurney!

Another Texas Outrage Against Handicapped

Maybe it’s my one-time Texas roots, but I just keep thinking, “Aren’t Texans smarter than this? How can they keep bashing the handicapped? Don’t they know that breaking federal law can be horribly expensive?”

But Texas HOA board members just keep doing what board members do best; their very worst.

Here’s another HOA kicking around a blind guy. He bought his home because it was just a few steps to the bus. The HOA built a fence that now requires this man to walk a mile to reach the bus stop. The blind fellow, by the way, is a lawyer. 

This is a no-brainer lawsuit, which of course will lead to special assessments against all the homeowners.

Wouldn’t It Be Great If We Could “Fix” HOAs This Same Way?

This link should put all sorts of ideas in your mind about how to fix up your failing HOA. If only we could Photoshop our neighborhoods the same way the fashion industry does its models:
 
 
 
36 seconds and “POOF!” Your HOA has no wood rot, no broken sidewalks, no dead tree limbs, dog poop, or peeling paint.  Wouldn’t that be amazing?
 
I actually have seen this very thing being done on real estate websites.  Potential buyers are stunned when they walk in and discover the kitchen is laminate, not granite. The pool isn’t out back, but three doors down in the board president’s back yard.  And the garage is a single not a triple.  And those beautiful multi-colored leaves on the maple tree outside the dining room picture window? That tree doesn’t even exist.
 
Deception is everywhere. Sadly, it’s becoming an acceptable practice.  But somebody always ends up a victim and reality hits like a brick.  This kind of deception is happening all across America’s homeowners associations.   
 
Life isn’t being lived like it’s portrayed in the pictures.

 

Massive Special Assessments Coming Your Way!

Homeowners in the Litchfield Plantation HOA in South Carolina are going to rue the day they bought into the neighborhood.

The former developer of the HOA was arrested for grand larceny after he transferred nearly a million bucks worth of HOA assets to his private company. The allegation was made by three residents of the community who got the developer ousted as president of the board and got themselves elected.

But a judge has ruled the developer was still in legal control of the HOA corporation when the money transfer was made, and that the three board members may have been improperly elected. The criminal complaint against the developer was dismissed. And guess what? The developer has now filed a massive defamation lawsuit against the Homeowners Association.

Millions and millions of dollars are going to be spent in this case. And who will win? Not a tough question. The lawyers will win.

And who will lose? Also, not tough. Individual homeowners who didn’t even know they were involved in a lawsuit will have to come up with the millions of dollars that are going to be flung into the pockets of lawyers at the respective law firms.

Litchfield Plantation homeowners? This lawsuit will only be financed through special assessments against your homes. You folks thought you were buying into a nice peaceful neighborhood. It’s going to be an angry cauldron with a lot of you paying a nasty price.

Elderly Man’s Home Seized by NC HOA

This is the kind of thing that blackens the eye of the typical Homeowners Association in HOA Amerika. Homeowners Associations seem to have a special fondness for seizing the homes of the elderly. Old people usually don’t have the money or the will to fight back. And a simple misunderstanding of a homeowner’s obligations leads, not to compassion, but to the kind of fascist actions that scare the crap out of American home buyers.

A 74 year old man in the Davis Lake Community Association in Charlotte, North Carolina, tried to get some family members registered at the local clubhouse and pool, and he was refused. He quit paying dues, and ‘sure as shootin’ his house was grabbed. 

Yes, he’s going through kidney failure and frequent hospitalizations. But that’s all the more reason for Davis Lake to grab his home. Bam! They can auction it off, re-route huge legal fees to a favored law firm, and toss a few bucks into the neighborhood kitty just in time for the summer picnic.

But this 74 year old?

Toss him into the street.

He’s a bum.
