Indiana Residents Fighting Eminent Domain for Private Development

I follow Institute for Justice on social media. See the link below for their recent press release about the Pleasant Ridge neighborhood of Charlestown, Indiana. This is yet another case where the city seeks to declare several city blocks “blighted” and to use state grant money to purchase 350+ homes for the paltry sum of $6000 each.

According to a June television report (link below), which includes interviews with Pleasant Ridge residents and Charlestown Mayor Bob Hall, early plans for development are to create a mixed use neighborhood consisting of duplexes, single family homes and affordable housing for seniors. In other words, probably another HOA, this one subsidized by tax dollars.

In June, Hall was quoted as saying that owners would not be “low-balled” on prices offered for their properties. At that time, Hall said owners would only be offered up to $15,000 from grant funds, and developers would have to contribute the rest toward market value. So the proposed offer price has already dropped by $9,000 in just 5 months, with no mention of Developer contribution.

The bottom line is that private developers want the land, so they can build new properties. The Mayor wants to collect higher tax revenues. Instead of dealing with individual properties that are in need of being condemned or demolished, the plan is to raze the entire neighborhood and displace hundreds of residents. Once again, the Supreme Court’s twisted definition of “public use” comes back to haunt American citizens. Fortunately, Indiana’s laws stipulate that eminent domain cannot be used for private development.

I find the following statement from the Mayor’s office particularly interesting,

“This area was declared blighted in 2002 in connection with a revitalization grant received then. The housing in this area was temporary housing bought by the army to house workers at the ammunition plant in 1940,” the mayor’s spokeswoman, Geneva Adams, said.  “They were not meant to be permanent housing. The decline of these structures is evident as you drive through the area.”

Has Ms. Adams taken a close look at the construction quality of many modern homes? I would be willing to bet that the majority of them will not stand the test of time as well as the Army’s temporary housing that is now 74 years old.

Beach Erosion Threatens SC Condominium

Stories like this one never cease to amaze me. Some people will do just about anything for an ocean view. An illegal sea wall and some sand bags are the only thing stopping the Ocean Club condominium from washing out into the Atlantic on the coast of South Carolina.

The million dollar unasked question is why was a construction permit issued on this site nearly 30 years ago? The resort sits at the mouth of the Dewees inlet, where waves batter the fragile coastline.  Adjacent to the condo building of 150 units, part of the beachside golf course had to be closed, slowly eroding into the ocean.

Condo owners face a hefty $750,000 fine from the state environmental protection agency for erecting the illegal seawall in 2013. Even after spending nearly $3 million trying to keep beach erosion in check, owners must once again replenish the beach next month, just as they did in 2008.

It’s a battle with Mother Nature that they are eventually going to lose – if the regulatory fees don’t bankrupt the Association first.

Wilbur Wins!

I am so happy to share this wonderful news from Rori Halpern. She is the mother who fought long and hard to keep the family’s pot-bellied pig for her sons.

“Long day for all involved. We are beyond elated to say Wilbur Bacone will remain forever in our home, continuing to bring joy and happiness to all. Due to confidentiality agreements between both parties we cannot share details. The only thing that matters is that we can keep our boy without anymore worries. Thank you from the bottom of our hearts to all who came forward in support of us. We love you all.”

It is no surprise that the notorious HOA “gag” order has been placed on the Halpern’s. Typical HOA style when they lose a legal battle. We know in this case they did lose because Wilbur is staying put. I sure hope the judge awarded the Halpern’s reimbursement for their legal bills and punitive damages for their pain and suffering.

Who wants to take a guess at how long it will be before the next HOA sues a homeowner over a pot-bellied pig? My guess: at least one more before the end of the year!

Stupid, Stupid HOA Board Members! Just Stupid!

The four board members of the Twin Creek South Estate Homeowners Association may be among the stupidest people on Planet Earth. These knuckle dragging hominids in San Ramon, California might even qualify for the infamous annual “Darwin Award.” Their collective IQ points could easily be totaled up on one hand.

California is in the midst of a drought so bad that smaller communities are now running completely out of water. Many Californians are paying big sums of money for water brought in by truck from other states. Reservoirs are bone dry. Aquifers are drying up or becoming too saline to use. The collective weight of trillions of gallons of missing water has actually caused land along the San Andreas Fault to rise significantly triggering swarms of thousands of mini-earthquakes. The Legislature and Governor have had to enact a law forbidding Homeowners Associations from fining residents who don’t keep their lawns green. More food crops are grown in California than in any other state, but those crops are no longer being shipped to the nation’s grocery stores. That’s why you’re seeing record prices on store shelves across the country.

Yet the Twin Creek South HOA board members have the unmitigated gall to assess monthly fines against a homeowner who tried to create a drought resistant lawn.

When a KGO-ABC news crew tried to talk to these board members they refused to comment.

Of course they did. They’re too stupid to put three words together in a coherent sentence.

If It Seems Too Good To Be True………..RUN!!!

What if you had a chance to buy a million dollar condo in one of Chicago’s fanciest high rises for a mere half million dollars? Wow! That’s luxury living for half the price. You trust the developer because he’s one of the richest, most famous, most successful people to ever convert high rise apartments into fancy, high priced condominiums.

What if you learned this famous developer was secretly trying to develop this project by borrowing millions of dollars at a 50% interest rate? As you look around at your unfinished condo, rancid unpainted hallways, and busted elevators wouldn’t you begin to feel a little bit queasy about your investment?

When you buy into any kind of Common Interest Community your heart, soul, and your net worth are all jointly owned by your neighbors….and the developer. The story linked below might make you long for that single family cottage way out in the country.
