Backyard Chicken Wars

So strange to think that a whole movement would begin around the subject of backyard chickens. In our American frontier, no one would give a second thought to a hen or two laying eggs for the family. But things have changed. Chickens are about as welcome in most neighborhoods as ticks on a picnic blanket.

Still, there really is a movement to convince city councils everywhere that chickens in the backyard can actually be a good thing. In fact, another small town in Colorado has just approved it.

Another strange thing is that chickens are often more frequently welcomed in city, not rural neighborhoods! They keep down pests, they supply eggs, and if there are no roosters around there’s not much noise. (Funny how it’s always the men who are life’s troublemakers!)

Ah! Don’t even think about chickens in the backyard if you live in a Homeowners Association. No, the neighborhood lawn Nazis want your lawn fertilized with strong chemicals, not natural things like chicken manure.

Can They Really Take My Guns?

Can my Homeowners Association really take my guns away even if it’s without any mention on my lease or CC&Rs? Yes, they can and do. Across the country HOA boards have denied homeowners their Second Amendment right to bear arms many times. As I keep saying, HOAs are not subject to the U.S. Constitution so they can ban just about anything they want.

In a recent case in Texas a homeowner was hit with fines and threats of foreclosure because he ran a website where he sold guns. Mind you, not a single gun ever came through this property because the homeowner never received any shipments. 100% of his guns changed hands on the Internet.

There was a kerfuffle last week in Colorado, when Ross Management, a company that manages a number of neighborhoods suddenly passed an anti-gun ban on all its properties. (Trayvon Martin effect?) Many retired military live in Ross developments and they hit the ceiling. There was negative news coverage across the nation and Ross has kind of, sort of backed away from the gun ban. For now.

It’s not the first outrage by this property management group, either. Among the rules residents have to sign is that they are forbidden from ever speaking ill of Ross Management. So, the next step may be evicting those homeowners who dared to speak to the news media about the ban on guns.

Nightmare Neighborhood, But Huge Win For Homeowner

This story is impossible to describe in my short format. But I encourage you to read the judge’s decision linked below. Rosemere Estates is a tiny Las Vegas neighborhood of just nine houses built in 1994. Everyone knows each other. The developer left some minor covenants in place, just four pages of innocent CC&Rs to maintain a few common areas. He never established a Homeowners Association or a Property Owners Association. There were no construction deadlines or restrictions against pets, rentals, etc.

In 1996 John and Trudi Lytle bought a parcel from the developer primarily because there were few, if any, restrictions on how a homeowner could use his property. A year later two of the nine property owners decided they wanted a mandatory Association with all the fascist, draconian restrictions that are so famous throughout the rest of Las Vegas. Their attempt failed.

In 2004, these two homeowners made another try, introducing a new set of proposed CC&Rs. Since any CC&Rs above and beyond the developer’s original ones needed a unanimous consent of the nine homeowners, the neighbors again refused to go along.

2007…another try, this time these two idiots filed Articles of Incorporation and falsely referred to ‘previous’ restrictions which allowed the ‘board’ to modify furutre restrictions without unanimous consent. The whole document was full of intentional lies and deceptions.

The supposed ‘new’ CC&Rs would be hilarious if the intent wasn’t so evil. One regulation amounted to a morals clause! It outlawed any use of a property if the board in its infinite wisdom decided the use was immoral, improper or offensive.

Another one: Any animal found off-leash would be immediately turned over to Animal Control. And any animal deemed (in the board’s wisdom) to be a nuisance would be banned from the neighborhood forever.

Does it get worse? Hey, Bunky, you ain’t heard nothin’ yet.

Any homeowner who wanted to build was given only 60 days to complete the project! That would be absolutely impossible for anyone wanting to build a custom home.

Homeowners were given a packet of legal mumbo jumbo and were told, “Ya don’t need to read it, Dummies, it’s a done deal.”

Well, after six years of costly litigation all the way to the Nevada Supreme Court and back, a judge has dumped on these two idiots and their fake HOA. He ruled in favor of the Lytle couple on all counts. He hasn’t yet announced the total, but he’s going to award six years worth of legal fees on both sides of the case to the Lytles. It’ll be a massive sum. But guess who gets to pay the award? All nine property owners, of course. If any of the nine can’t afford their share of the judgment they can be foreclosed upon.

Now what would it feel like to live in Rosemere Estates for the next twenty years?

Darcy Spears Pitches A No-Hitter

Yes, it’s one, two, three strikes you’re out…..

And for a third time, Darcy Spears of KTNV TV has gone to the Southern Highlands Country Club area and learned it’s a community of frightened homeowners with a leadership of gangster-minded bullies. Maybe that just comes naturally for people who move to Las Vegas: Find out how to join the Mob! In her latest HOA Hall of Shame report she tries to locate the skunks who are trying to chase a black man out of the neighborhood.

Even though Louis Washington is one of the original residents of Southern Highlands, the HOA is demanding that he plant a couple of trees in his yard. Never mind that the country club just behind Washington’s house, has a few trees that clearly look like they’re dying, this monstrous HOA tyrant wants the homeowner to plant a tree right in front of his picture window, or they’ll fine him out of existence.

Darcy says this is the third time Southern Highlands has been on her Hall of Shame report, Readers of my book, Neighbors At War already know about Southern Highlands for the way it treats black families. Just go back and re-read chapter eight where I document the shameful history of Homeowners Associations and minorities. Southern Highlands is featured. In 2006, Troy McMullen, a reporter for The Wall Street Journal Online did an investigative story on how blacks are treated at Southern Highlands. It was called “Trouble in Paradise: Minorities Report Bias in Vacation areas.”

Some people just have no shame.

 One footnote: the management company which runs Southern Highlands brags that it sends out a thousand violation notices per month. Am I wrong, or does that sound a little fascist to you?

 

While Humans Fight, Dogs And Cats Are The Peacemakers?

When it comes to squabbling neighbors, is it possible that dogs and cats have found the moral high ground?
 
Witness the surprising discovery made by Michelle Smith, animal control officer for Anderson, South Carolina. She heard some pitiful yapping coming from a ravine behind the Home Depot store. It turned out that a little Shih-Tzu was making the ruckus to attract some human attention to her predicament.
 
This Shih-Tzu was tiny, but she must have a huge heart. She had apparently discovered an orphaned kitten and was trying to keep it warm. The Shih-Tzu was actually nursing the kitten.
 
Wow! Talk about good neighbors. Remember, this was in South Carolina where each and every day humans torture one another with their stupid predicaments.
 
There must not be any lawyers in the dog and cat community.
 
Oh, that’s right. There aren’t.
