The Lawn Nazis Grab Another Home

Each story I read disgusts me more: A Homeowners Association in the Colorado Springs area has foreclosed and auctioned off a 350,000 dollar home for about 11,000 dollars. And the homeowner never saw it coming.

Christopher Wright lived in the Woodmen Hills Filing Number 11 HOA. He thought he was fighting a fine for leaving the kids’ bicycles outside, but he discovered that the home was really taken because he hadn’t been paying his annual dues. His $900 nonpayment had turned into more than $10,000 worth of late fees, collection fees and attorneys’ fees. But non-payment of annual dues in most HOAs is a more serious crime than rape, armed robbery or burglary. Overstatement? No, rape and armed robbery usually net a less serious sentence than the confiscation of one’s home.

The management company is owned by Associa, which in turn is owned by an ethically-challenged Texas State Senator who has long faced criticism for his shifty dealings. Senator John Carona is a billionaire who owns or controls more than 8000 Homeowners Associations across the country, many of which are required to use insurance companies he owns, banks he owns, the list goes on and on. Media criticism of Carona’s ethics goes back years.

But none of that really impacts Christopher Wright’s case. He lost his house. And he’s dazed and confused about the Constitutional rights he thought he had.

Was Christopher Wright just stupid? Some would say so. But others would look with awe at the record of the Woodmen Hills Filing Number 11 HOA.

853 homes.

225 liens filed.

126 lawsuits filed.

4 foreclosures.

About his sky-high fees, the Woodmen’s HOA attorney, Hal Kyles, of the law firm Orten, Cavanagh and Holmes says, “I’m not cheap.”

No, you’re not cheap, lawyer Kyles. You’re not. But you are arrogant.

Shame on you for your arrogance.

Ouch! Things Get Nasty!

The latest neighborhood nastiness comes to us from Newport News, Virginia and the Kiln Creek Homeowners Association. Eight years ago Bill and Janeth Garlette built a koi pond in their backyard. And for eight long years the HOA has approved of their pond and their various gardening improvements. 

All of a sudden, a new HOA board has hit the couple with two dozen alleged violations of neighborhood covenants. The couple’s attempts at fighting the allegations were futile, so Garlette ripped out the koi pond and razed the backyard to bring it into compliance. But even that wasn’t good enough, and the HOA has filed a 300,000 dollar lawsuit.

Yes, there are allegations of death threats back and forth between the Garlettes and a neighbor who they think instigated the HOA lawsuit. And yes, the Garlettes say they are now officially out of money.

HOAs claim they were set up to protect property values. But this is one neighborhood where property is going to be very difficult to sell.

Newly-elected HOA President Exercises Power…Off To The Court House They Go!

Kenneth Torrence is a Palm Beach sheriff’s deputy. His best friend is his mixed breed dog, Sasha. But they both have the misfortune of living in the Whispering Woods of Palm Beach Homeowners Association. Kenneth and Sasha have lived there for two years with no problems.  

Suddenly, a newly elected HOA president, Maria O’Connell, says Sasha is a pit bull and has to go. In fact, a  letter sent by Castle Management LLC says, “If you do not take action to resolve this violation within (10) days of the date of this letter, the Association will have the work performed, with all costs charged to your account.”  
 
What are they planning???  To steal his dog?  Put her in the animal shelter? Euthanize her?  
 
Animal activist Maria Rivera says Sasha isn’t a pit bull. In fact, a DNA test showed she’s a mix of five breeds. Besides, Rivera says, other neighbors and their dogs like Sasha. The only one who doesn’t is Maria O’Connell.
 
Torrence says he’ll take it to court. Initial legal costs will be around $30,000.  But just wait and see what happens when the HOA pulls in its insurance-backed legal team to beat up on the deputy.  That 30,000 will be nothing more than seed money. 
 
I say, Kenneth, pack up Sasha and move!  Make a donation to the local animal shelter instead of paying for another vacation home for the HOA attorney!
 
 

Flying Low In Roxborough Park

These Douglas County, Colorado residents aren’t pilots but they are driving so fast they nearly ran over their neighbor, Diane Powers, twice in one night!  One speeder wiped out a 30 foot tree and if he loses control on that curve again there’s a big rock in its place now.
 
Warning!!!  This HOA is using camera-equipped radar and tickets will be issued to homeowners which will include any of their guests who are caught speeding. Oh yes! If the pizza delivery girl is trying to deliver it “hot and on time“…you could get hit with a fine for her misdeeds.
 
Homeowners, wonder what will be next?  Well let’s see…how about breathalyzers, seat belt checks, texting, eating, sneezing, and talking-on-the-cell while driving?  Brace yourselves for the “wannabe cops” patrolling the streets of Roxborough!
 
Speed bumps were removed because they interfered with snow removal and emergency response time.
 
If things don’t change, I suppose they could always require owners to park at the gate and walk from there.
