Georgia Marine Loses Right To Fly The Flag
A patriotic member of the U.S. Marines tried to fly both the American Flag and the Marine Corps flag outside his home in Atlanta. But the Sun City Peach-Tree Homeowners Association says he’ll be fined, sued, liened and foreclosed if he does so. Seems that Sun City will only allow one flag at a time (Southern Homeowners Associations have been consistently losing their fight to ban all flags).
The Griffin Management company thinks it has total control over its homeowners and can micro-manage every aspect of their lives.
Former Marine Captain Jim Lowe still has the spit and fury of a U.S. Marine in his heart and says he’s going to fight. But his Homeowners Association is fining him 25 bucks a day each time they spot the reviled Marine flag on his flagpole.
Captain Lowe and his wife say they plan to move out of the community. Apparently they’re just now realizing that Amerikan Homeowner Associations are not really part of America. And he wants to move back into the country that he loves.
BTW, it’s not about this man’s right to fly which ever flag he chooses. It’s about the equity in his home. No HOA fines a guy unless it first checks public records to see how much equity there is. Follow the money, folks. Never follow the ideology or the reasoning behind stupid board decisions. Follow the money. It’s all about the equity and how much can be seized and transferred to the HOA’s operating budget.

Are HOAs A Scourge?
Some homeowners describe it as such. But when HOAs lawyers advise it to do the kind of thing linked in the video below, it’s worse than a scourge. It’s actionable illegal conduct. What if this homeowner had to leave home to attend to an emergency at a local hospital? This would be a lawsuit with no bottom line on damages. This lawsuit could cost the HOA millions and millions of dollars.
Stupid lawyers.
The Earth Shakes In Nevada!
Unbelievable!
Nevada, where HOA bigwigs have been smacked with dozens of federal indictments and convictions for racketeering, is now leading the nation in trying to offer due process to homeowners. It’s only a proposal in the Nevada Real Estate Division, but what a concept!
Due process.
It’s just a handful of words in some obscure part of the Constitution.
But it’s almost beyond comprehension that Nevada homeowners might someday have real access to the Bill of Rights.

Fair Housing Law Be Damned!
One of the few ways that Homeowners Associations consistently lose is discrimination against the disabled or handicapped. Still, in HOA Amerika it’s all about intentionally violating the law because the disabled generally don’t have the money to fight. Occasionally HUD will move in and assess massive fines against an Association. But even that hasn’t made much difference.
The story linked below is about an elderly Florida woman, Claribel Ruiz, who has crippling anxiety and depression. Her doctor advised her to get a companion animal, a Chihuahua which has become a life saver for her.
“Not so fast!” said the Chancellor Hall Condo Association. “Dogs aren’t allowed. We don’t give a flying fig about the American Disabilities Act. Get rid of your dog or we’ll do it for you!”
Claribel’s dog is a registered therapy dog and she even gave her HOA the doctor’s prescription for a therapy dog. The HOA’s attorney then demanded that Claribel surrender all of her medical records to the Association. She refused and finally told the Association that she would give up her dog.
“Great!” said the Association. “That’ll work, but only as long as you pay all of our legal fees!”
As this blogger sits here reading this poor lady’s story, three things stand out: The woman is single, she’s elderly, and her last name is spelled ‘Ruiz’. That’s three strikes, right there!
Where’s HUD help when someone really needs it?
