CAI is the modern incarnation of the Ministry. If, as has happened, CAI goes unopposed with its ongoing propaganda campaign about the grand and glorious benefits of HOAs without even whispering “constitutional violations” or “de facto private governments” who will believe anything is amiss?

What? Those malcontent, troublesome homeowners who don’t know how to live in a community with rules? That handful of trouble makers? They can’t even write decent legislation! Let the CAI lawyer/lobbyists explain the issues to you legislators so you can make better decisions.

Who would you believe?

Over the years CAI in Arizona has been basically silenced in the public media, because I would confront, challenge, and expose their lunacies and false statements whenever I could.

In the 2000 – 2005 time period the CAI repeatedly slandered homeowner advocates. We often heard statements from legislators like, “You’re just trying to get out of a contract.” “You agreed and you should have read your contract.” “Anyone who didn’t read or understand their CC&Rs and signed anyway was really stupid. I wouldn’t do anything like that.” Or even worse, “If you don’t like your HOA, just move out. That’s all!”

This year the Arizona Legislature approved SB 1482 without any questions being raised in committee. The bill was simply voted on and passed. Why? An almost identical bill was passed last year but failed in the courts. Also last year I repeatedly confronted and exposed CAI simply by quoting erroneous statements their lobbyists had made in public. Many legislators began to realize CAI was feeding them bad information. Of course, the previous law was eventually thrown out by the courts because it was fundamentally illegal.

However, CAI lobbyists still walk the halls of the legislatures whispering in each lawmaker’s ear, spreading the same old disinformation. This will never change unless voters contact their legislators and truly educate them on the issues.

My Own Brother!

One of my brothers is an attorney in Washington State. He and I don’t quite see eye to eye on the national disgrace known as Homeowners Associations.

So I was sort of stunned this afternoon after listening to him being interviewed on a Seattle radio station. I never knew that he was a historian and expert on the American Revolution. And I didn’t realize how articulate he was on the importance of revering and respecting the Declaration of Independence and the U.S. Constitution.

I have a link posted below to his interview. You’ll have to wade through about 13 minutes of babble about restaurants and cuisine. You can quickly skip ahead to the second section to hear my brother’s interview.

But as you listen to Gregory Lucas talk about what led to the American Revolution and the formation of the Constitution and the Bill of Rights, try to compare some of that to our current revolution against the abusive and fascist HOA movement.

Our anti-HOA movement is all about the rights our forefathers reserved for us and how in recent years we’ve allowed our homes to be swallowed by massive corporations which don’t have to honor any of our traditional rights.

If you end up listening to this interview, please give me some advice on how to steer my brother over to our side in the HOA fight.

Listen, As Never Before!

On American Independence Day 2014, is it time to implement “Equal Justice Under The Laws” For HOA & Condo Owners?” Are legislatures willfully violating our citizen rights? If so, why?

Are the following not true?

– Federal Laws require all states to comply with the US Constitution as the Supreme Law of the Land.

– States are required to support and defend the US Constitution when passing statutes and implementing regulations.

– States, counties and cities are required to support and defend the US Constitution in their statutes, regulations, rules, codes, etc. that bind all citizens.

– Local government rules, regulations, codes, etc. establish the controlling concepts and limitations in CC&Rs for when, how and by whom Homeowner and Condo Associations are established, maintained and how the property owners are governed in addition to standard government restrictions.

– So, why can the state and local government authorities legally allow developers to implement CC&Rs that violate the Constitutional rights and protections of HOA and Condo property owners? Is this not morally deficient, if not exactly illegal?

– Is this not a clear case where the government is violating its own agreements and mandates to “EQUALLY” support and defend the Supreme Law of this Land for all citizens?

– Does claiming that because HOAs and Condos are created as special, quasi-governmental corporations there is no moral or legal obligation to protect all citizens equally under our Supreme Laws stand up to even plain old common sense arguments?

– How can state government authorities, on one hand, rigidly control the creation of property and the associated governance regulations and rules of HOAs and Condos; but, on the other hand, (much like the Pontius Pilate of the Bible) ignore the fact that they are directly aiding and abetting the conscious denial of equal justice under the laws for HOA and Condo owners?

On American Independence Day, please explain why such crass injustice can be tolerated and ignored by so many in this industry?

Why won’t every single one of you Americans reading this topic stand up and demand “equal justice under our laws” for HOA and Condo owners?

Another American Flag Outrage

Yes, I know I’m harping, but every time I see one of these outrageous stories about homeowners not being allowed to display the Stars and Stripes I’m going to erupt.

As I’ve said before, I have five family members buried in Arlington, another war hero family member buried in a National Cemetery in Portland, Oregon. These men and women stood for a principle, that the American ethic means something. It means we’re courageous in the face of evil. It means we stand up for what’s right and against what’s wrong. It means that when we realize we’ve made a mistake we have a Constitution that allows us to correct it. It means if our leaders in the White House, the Congress, the Senate or elsewhere are too wimpy or too cowardly to stand up for what’s right, we have the right as American voters to toss their butts into the street.

For this Vietnamese hero fighting for his right to fly the American flag in a Houston apartment complex, I say we support him in every way possible.

My Ego Conflict

I hate to call it a character flaw while still admitting the possibility that I’m sometimes loathe to reveal ‘insider information’ about the Neighbors At War website. But it’s clear it’s becoming a growing clearinghouse of ideas proposed to solve a serious social problem. Sure, I’m a mercenary trying to pump up sales of what my ego tells me is a pretty good book. At the same time, large numbers of people are actually coming together and learning and sharing ideas on how we radicals, we wretched masses of the discontented can come together to have a profound impact on changing a very flawed American institution.

But once again, the numbers are part of the story. And here they are. By the end of June more than 3 million pages of material from this website will have been taken into the public domain over the past twelve months and used, hopefully, to educate other people about the dangers of living in, or getting involved with a Homeowners Association.

388 thousand visitors have taken the time in the previous twelve months to read, copy and pass judgment on these pages. And that means that all 388 thousand visitors have decided that Neighbors At War, not only gives them a forum where they can exchange ideas, but it also gives them new ideas about understanding a unique American conundrum: Why are so many millions of Americans willing to voluntarily surrender fundamental human and Constitutional rights in order to ‘join’ mini-Socialist enclaves where ‘groupthink’ is used to homogenize the thoughts and behaviors of all other members. Is small-scale Socialism as expressed in the HOA model really as fearsome as many of us think? Spying on neighbors to model and control behavior just seems so fascist. What am I missing?
