Only Way To Battle Embezzlers is Use Their Names

Shawn Marie Bianco, of 109 Georgetowne Court was arrested by the Sheriff for embezzling from three organizations in Virginia. Two were Parent-Teacher Organizations. One was the Georgetown Court Homeowners Association.

She said she needed the money for several things, including braces for the kids’ teeth.

Oh yes.

She asked her friends not to mention her name anywhere.

God Bless George Staropoli!

George Staropoli, better known as “Starman,” one of the heroes of the American anti-HOA movement, has posted an amazing debate in the Arizona Legislature about abuses in the typical HOA.  The relevant portion begins at 39 minutes into the hearing.  It’s a perfect examination of some of the unconstitutional horrors that occur in today’s HOA.  Please watch. It’ll help you understand some of the idiocy that dominates some of the nation’s HOA madness.

Mob Mentality in Las Vegas HOAs

We haven’t heard much lately about the Las Vegas Homeowner Association scandal and the federal investigation which has already obtained ten guilty pleas against public figures for corruption. But, we may as well do this blog to keep Las Vegas criminality in the headlines.

The Mountain’s Edge Homeowner Association is being sued by investors who tried to snatch up foreclosed homes in the Vegas area. In the mortgage collapse, investors have taken a huge risk in trying to buy up homes which were abandoned by bankrupted homeowners. Those investors are just about the only financial thread keeping entire neighborhoods from going under.

But investors are now filing complaints or suing dozens of HOAs which they claim are gouging them with inflated liens and excessive dues, fines and collection costs. The old wisdom is “don’t bite the hand that feeds you.” Investors are pouring money into dying neighborhoods, but HOA boards are slamming them with fistfulls of phony fines.

The mortgage mess will take years to clear up. But many Las Vegas HOA boards don’t seem to “get it.”

Welcome the investors. Bring in the investors. Use their money to prop up your dessicated neighborhoods. But if you use your customary mob mentality against this new money, you’ll end up paying a high price.

The obvious message to investors is… “never buy a home in an HOA. Not in Las Vegas. Not anywhere.”

Gunfight in the “Not OK Corral?”

Some desperate homeowners in the underwater mortgage markets of California, Nevada and Florida may be turning to a garish, and undoubtedly illegal way of keeping up with the mortgage. They’re allowing their homes to be turned into giant billboards.

Reuters News Service is reporting on a family in Buena Park, California who permitted a marketing firm to convert its home into a giant “Brainiacs From Mars” billboard. Some neighbors are furious, even to the point of threatening gunfire. Others are looking at their own underwater mortgages and wondering if they should take a second look at accepting a second stream of income.

The marketing firm says it has about 38,000 applications from eager homeowners around the country. The campaign will generate lots of publicity for “Brainiacs,” but it’ll be a rare billboard that stands for more than a month.

Although homeowners have been promised up to a year’s worth of mortgage payments, city codes and HOA covenants will soon come crashing down on advertising that doesn’t conform to local laws.

Gather a group of people who are members of different homeowners associations and you’ll hear tales across the spectrum of human behavior. Some HOAs are run by groups of well-intentioned, reasonable people who want to help their neighbors and see to it that their association quietly performs the duties of mowing grass, doing repairs on common areas, maintaining a certain level of neatness, watching safety. They try to do their duty without interfering much in neighbors’ day-to-day lives.

And then there’s the other end of that spectrum, where perhaps one or two association leaders mistake their roles for those of drill sergeants or monarchs. It’s their way or the highway, and if they have a grudge against a neighbor who, say, once dared to complain, they don’t mind using the association to intimidate that person.

There’s a reason why a legislative committee has been hearing various accounts about HOAs with an eye toward further regulation, and it looks as though further regulation is needed. There were too many accounts recently at a committee meeting about associations that went after neighbors, including to the point of trying to foreclose.

The General Assembly can start right there. No homeowners association should have the power of foreclosure, end of story, period. Taking someone’s home because they’re late with dues? No. Some association leaders who appeared before lawmakers actually tried to defend that right. And, there should be a line of appeal for alleged excesses on the part of associations besides an expensive trip to court.

Some HOA leaders resist the idea that anyone needs to tell them how to operate or put limits on their powers. But they need instruction, and they need regulation. Strict regulation, with consequences for associations that don’t comply.
