HOA Cancels the 2nd Amendment to the Constitution

I’ve long argued that signing HOA documents for all intents and purposes, trashes any rights a homeowner thinks he has under the U.S. Constitution. The Second Amendment says the government may not interfere with the right to keep and bear arms.

But the Pleasant Hill Condominium in the Bay Area thinks it has a better idea than the U.S. Constitution. Guns aren’t politically correct, so anyone with an interest in guns deserves to be tossed into the street.

By way of background, Rico Tedjakusuma requested a home occupation permit for LNC Arms, an online firearms business. He doesn’t sell guns from his apartment. He’ll be federally licensed. His gun purchases will never go through his apartment building, he’ll just serve as a broker between customer and buyer, all on the web. No buyers will ever visit his apartment, he will literally use his apartment for record keeping. But Pleasant Hill Condominiums, which as an HOA has more powers than state government, has decided that it doesn’t like the concept of a gun broker living an apartment in their complex. They want him gone.

In a state that’s on the verge of financial collapse because of Governor Brown’s sudden “discovery” that California is 16 billion dollars in the red, you’d think that California would be begging for entrepreneurs to help turn the state around.  But the PC movement is so much larger than common sense.

Are HOAs Facist?

I like pondering this question. Sadly, I can’t find the link for proper attribution. But the blogger talked about a statement made by Franklin Delano Roosevelt to a 1938 session of Congress. Here it is:

“The liberty of a democracy is not safe if the people tolerate the growth of private power to the point where it becomes stronger than the democratic state itself. That, in essence, is fascism – ownership of government by an individual, by a group or by any controlling private power.”

Whew! Sort of takes your breath away, doesn’t it? By casually stepping into a new form of government called the Homeowners Association movement, are we not giving away all of our Constitutional freedoms without giving it a second thought?

Sure, we’d all like to live in neighborhoods where property values aren’t brought down by some goofball with the muscle car on blocks and a trash can that never leaves the curbside. But at what cost? In the 1930s millions of people joined the Nazi party because they truly thought their membership was bettering themselves. They were truly enthusiastic about where their new party was leading them.

But are we going to sit back some day and ask ourselves, “did we once have something very special in this country, and we gave it all away?”

Texas Takes Aim Against Another Serviceman

Bill Fry, an officer with the Army National guard, was returning from fighting in Iraq. All of a sudden he learned his HOA, The Spring Lake HOA of Mineoloa, Texas, had filed a lawsuit against him and his family because they put up the swingset to keep his kids company while he was gone.

It’s not an outrageous swingset. It’s not candy apple red and doesn’t flash with florescent colored lights. It’s just a nice wood and canvas politically correct swingset. But the officials at Spring Lake have gone apoplectic. They want it taken down, NOW!

Fry says the HOA approved the swingset before he left for Afghanistan. But the new board claims Fry’s wife didn’t get final approval and obtain final plans. It’s not that the swingset is wrong. It’s that someone on the board had a bruised ego because she wasn’t personally asked for her permission. There’s a chapter in my upcoming book, “Neighbors At War” which scientifically shows the changing chemistry in the brain when someone feels they’re not being awarded enough power over others.

In any event, whatever compromise Fry attempts to make, the HOA turns him down flat.
Spring Lake HOA, in Mineola, Texas. It might be nice to visit. But I sure as Hell wouldn’t want to live there.

Here Come the HOA Lawsuits

As predicted in this blog, the Homeowner’s Association Movement is going to die a long painful death, taking down with it the fortunes, the home equities, the retirement savings of a whole lot of innocent people. On second thought, perhaps the word “innocent” is being too innocently thrown around, here, because most people living in HOAs know that they’ve allowed board officers to become little nazis as they patrol the neighborhood for violations. If you know about a problem, and you allow it to grow, lawyers are going to be digging deep… into your deep pockets.

There was never any question that Trayvon Martin’s family was going to sue George Zimmerman AND his HOA for permitting Zimmerman to patrol his neighborhood with a gun.

Now, there’s word of another gun incident: a 65 year HOA president in the upscale John’s Cove community in Orange County. “Upscale,” by the way means “soon to be downscale” as soon as the lawsuits are filed.

This HOA president is Michael Hudzik, who yells and curses at people as they drive to fast out of the gated community. Yelling and cursing wasn’t enough for one dad and his son who were planning on going jet skiing. This time Hudzik pulled a gun and ordered the dad and his son out of their car.

Neighbors won’t talk to the media. They fear retaliation from Hudzik. Well, neighbors, you elected this guy. Now, you may as well get out your checkbooks because your negligence is going to cost you a bundle.

While we’re on the subject of negligence, how about The Ole at Lely Resort in East Naples, Florida? Their bylaws they say that children under 18 are not allowed to play outside!  Really!  Isn’t there a federal law against that? And wouldn’t you think lawyers are now patrolling the streets looking for potential clients?

Finally, there’s the taxpaying veteran in the Sweetwater HOA in Jacksonville, Florida. His HOA has been fining him daily for displaying an American flag outside his door…exactly the kind of behavior that someone named “Bush” signed into law not too long ago. There’s a legal settlement in the wind. But somebody’s going to have his pound of flesh from that HOA.

I’ve said it before, and will probably say it again, but every person interested in the HOA debate should see this guy’s website.  I’ve never met him, although I’ve spoken to him on the phone once.  He has some incredibly interesting insights that make me extremely jealous, i.e., I wish I had thought of them first.

Do yourself a favor and bookmark  RightToOwn.org.  Dear God, I wish I could plagiarize!

Also, encourage this guy to write a book.  He’s articulate, intelligent, and a book or documentary from him could help us in the war to make the HOA movement fair, honest and responsible, three of the characteristics which are absolutely non-existent today.
