Why Do HOAs Keep Electing Losers?

The Windemere Condo Association in Will County, Illinois is facing a big embezzlement. At last count they were missing about $150,000.
The suspect? The guy now under arrest and facing charges of embezzlement? Oh, he was just the Condo Association’s president.

A Grand Jury says Bob Dorosz has been stealing since January of 2007.
One last thing: The police report on his arrest says his home address is….. homeless.

Of course. It all makes sense.

On American Independence Day 2014, is it time to implement “Equal Justice Under The Laws” For HOA & Condo Owners?” Are legislatures willfully violating our citizen rights? If so, why?

Are the following not true?

– Federal Laws require all states to comply with the US Constitution as the Supreme Law of the Land.

– States are required to support and defend the US Constitution when passing statutes and implementing regulations.

– States, counties and cities are required to support and defend the US Constitution in their statutes, regulations, rules, codes, etc. that bind all citizens.

– Local government rules, regulations, codes, etc. establish the controlling concepts and limitations in CC&Rs for when, how and by whom Homeowner and Condo Associations are established, maintained and how the property owners are governed in addition to standard government restrictions.

– So, why can the state and local government authorities legally allow developers to implement CC&Rs that violate the Constitutional rights and protections of HOA and Condo property owners? Is this not morally deficient, if not exactly illegal?

– Is this not a clear case where the government is violating its own agreements and mandates to “EQUALLY” support and defend the Supreme Law of this Land for all citizens?

– Does claiming that because HOAs and Condos are created as special, quasi-governmental corporations there is no moral or legal obligation to protect all citizens equally under our Supreme Laws stand up to even plain old common sense arguments?

– How can state government authorities, on one hand, rigidly control the creation of property and the associated governance regulations and rules of HOAs and Condos; but, on the other hand, (much like the Pontius Pilate of the Bible) ignore the fact that they are directly aiding and abetting the conscious denial of equal justice under the laws for HOA and Condo owners?

On American Independence Day, please explain why such crass injustice can be tolerated and ignored by so many in this industry?

Why won’t every single one of you Americans reading this topic stand up and demand “equal justice under our laws” for HOA and Condo owners?

It’s Not About A Flag, It’s About Testosterone

I swear, I’ve gotta quit doing stories about outrageous treatment of the American Flag, there are just too many of them. I could get stuck doing 12 or 15 stories a day. Still, I feel duty-bound to at least occasionally tell you when the latest cretin is pushing around his weight after having been given new power over other homeowners.

The latest victim of a flag outrage is a retired veteran named Larry Murphree of the Tides Condominium at Sweetwater, Jacksonville, Florida. It’s actually just a small flag that he placed in a flower pot on his porch. You can barely see it. It’s sticking in the flowerpot behind the right porch rail in the photo below. He’s been fined $8000 before and he got it settled in court.

After his court victory, Larry replaced the flag. And once again he’s being sued for $8000 and confiscation of his home. Here’s a very tight shot to show you a real good closeup of this tiny flag.

“It’s worth fighting for,” says Larry. “It’s a small flag but it stands for a big thank you and it shows the love and respect I have for my country.”

Larry, a little advice here from someone who knows. It’s not about the flag. It’s about a brain chemical called Oxytocin. If you don’t know about it look it up. When a chimpanzee of either sex is placed in a cage with a bunch of other chimps at the zoo, there’s an immediate disturbance. The new chimp races around the enclosure showing off his or her ‘equipment’, spraying the cage, making other chimps a little frightful of his or her prowess. Jane Goodall spent a lifetime studying this kind of behavior in all kinds of primates.

Larry, you’re being victimized by a new board member who thinks his or her virility is a little more chemically tinged than yours. Or maybe this board member wants you to think his or her influence among the weaker members of the tribe will carry more weight on the evolutionary scale. Whether you’re an evolutionist or not, you cannot deny that chimpanzees share approximately 96% percent of their DNA with humans. They (and orangutans) are our closest relatives. In so many ways, they’re a lot like us and we can learn from them. Your flag fight is not about patriotism. It’s about simianism. It’s about oxytocin. It’s about sex.

All science aside, there’s perhaps a bit of usable truth here. Spread this blog far and wide around the Tides At Sweetwater condominium complex. Without putting yourself in a slander trap, figure out which tiny dickensonian creature has been causing you all this misery. The good women of the Tides at Sweetwater know that as a veteran you probably came from good genetic stock. They’ll respect you. Then gather the whole community’s support as they publicly and visibly show this ‘little’ simian how ‘little’ they think your challenger’s virility really is. Each hour of each day when those community members greet that simian they should hold up their fingers about one inch apart. It’s just a guess. Just to show how much that person is regarded in the community.

Most journalists won’t tell you all of this. But since I know a little about science I will.

Real Tragedy Developing in the Las Vegas HOA Scandal

In four decades of investigative reporting, what always burned my butt was the sweet sentences given to white collar criminals by Federal Judges. A little personal confession here, one I probably shouldn’t make, but once I became good friends with a major white collar criminal who should have been sentenced to ten years, not ten months! I like this guy. I like him a lot. I consider him a great friend. But he’s an admitted crook who’s made that same confession on national TV. And he knows he skated with only a fraction of the prison sentence he really deserved. He took great delight in talking about how easy his sentence was. He considered it a vacation, a temporary escape from a difficult domestic situation and had the benefit of an admiring Federal prison warden who occasionally took him to town on weekends to meet women! In fact, he says he got more straight sex as a federal prison inmate than he did as an outsider.

Cut to the current Federal Organized Crime Syndicate in Las Vegas which has raped and pillaged Homeowners Associations up and down the valley. 39 suspects, four of them dead in highly suspicious ‘suicides’.  And the federal judge in the case is beginning to hand out what the crooks all call “pussy” jail sentences for their involvement in this hundred million dollar scam. The first prison sentences look like they’ll be about a year in federal prison. Easy duty. Over before you know it. And if you’re a good crook and keep your mouth shut about your confederates there’ll be a few handfuls of big bills to get your new life started on the other side.

This Organized Crime syndicate stole a hundred million dollars from Las Vegas homeowners. As a homeowner, all you have to do is look at the current value of your home to know how much money they stole. But even today, the powers that be who won’t be named are two of the most prominent political names, men who made millions and millions of dollars for ‘ignoring’ or even participating in this vicious scam.

Folks, just believe this crusty, hardened, wizened 40-year investigative reporter: some very big people are being overlooked in the Las Vegas RICO investigation. The Feebies (FBI) are intentionally hiding their eyes. There are at least two names who, if indicted, would be huge.

One or two of these names could actually change the political balance of an entire country!

The Wonder of Sworn Testimony & Public Records!

Recently, I have talked with HOA members locally and across the country who are frustrated because they cannot see the financial records in their HOA.

One homeowner requested to see ONE financial document and was told by the Associa management operation that a $200 advance payment was required to see it! Others have gotten the same old song and dance about paying to see the HOA records.

Back in 2007, it was discovered after much stalling and excuse making by the board president that Quivira Falls had $10,000,000.00 unaccounted for. Yes, that figure is TEN MILLION DOLLARS!!! And the audits had not been performed for years, as required per the by-laws. A homeowner filed a pro se lawsuit to see records. Five months later, I filed a lawsuit to recall the board and gain access to the records.

At that time, I was fairly new in the neighborhood. But my corporate experience helped me recognize I was dealing with some shysters. Shifty eyes, mumbling and bumbling, couldn’t give me a straight answer, nervous, cocky, stalling, and quickly trying to dismiss my questions always with “we’ll take that under advisement.”

Before the homeowner filed the pro se case he told the board members, “If we find embezzlement somebody is going to jail!” The response was a finger pointed at us and a booming angry voice from the HOA president, “If you think there has been any embezzlement or malfeasance, you’ll never find it!”

This guy had been the Quivira Falls Community Association president for 26 years! Homeowners had made no efforts to question anything he did. One of the board members, Jody Lamping said he put her through “mental masturbation” but never answered questions with legitimate answers.

Ongoing investigation was revealing more and more eye brow raising information. One being this Quivira Falls HOA president was running for the board of an HOA in Carlsbad, California. He had just purchased two places in that community. His bio read like Mr. Magnificent in the world of homeowners associations. Several residents of Quivira Falls contacted the manager of the Carlsbad HOA and his name was immediately pulled from the ballot. Ryan Rader died a few days later.

When Johnson County Judge Thomas Sutherland, ordered the records be turned over to me Rader’s successor, Jody Lamping, under oath, proclaimed, “there are no records!” Judge Sutherland gave her fair warning of perjury charges should records turn up at a later date. That did not deter her one iota, she threw her nose in the air and declared, “there are no records!” The board treasurer, Bill Reavis claimed Quivira Falls Community Association had no bank accounts, either.

I contacted the Johnson County District Attorney’s office and was instructed to file a “suspicion of embezzlement” report with the Overland Park Police. The detective ultimately hit dead ends because current and former board members claimed no knowledge of anything, stating only Ryan Rader knew about the inside workings of the HOA. What he did find was thousands of dollars in cash logged onto the ledgers but not one dime was ever deposited into the numerous bank accounts that Quivira Falls had established around the Kansas City area. The detective had no way to obtain information from a dead man so the case was closed, but he advised me to contact him if anything changed.

A year later, a homeowner that was very familiar with the details walked into the clubhouse and caught Jody Lamping with another board member and a former board member shredding records. I was called and my attorney instructed me to go immediately to the clubhouse with witnesses and cameras which we did. Jody Lamping was so nervous her mandible was flipping back and forth like a pendulum on a one hundred year old grandfather’s clock. The former board member was hiding on the staircase behind a wall, while the other was pretending to be on the phone to the HOA attorney letting him know the HOA records had just been found. Thinking we hit a goldmine, I called the detective. It was no surprise when he said that was not true because two months after the judge ordered the records turned over to me he was given access to those records!

There are more stories to this “new” board that promised Quivira Falls homeowners they could be trusted, but I’ll share those at another time.

For now, it’s best to say, DO NOT HAVE A BLIND FAITH AND TRUST IN YOUR HOA BOARD MEMBERS!

Do not allow anyone to be the president of the HOA for decades. I would suggest limiting that position to 1-2 years.

Do not allow 1 or 2 board members to be signers on HOA checks. Have 3 people and be sure they are all qualified to be bonded and do background and credit checks on them. If they have a criminal history or financial problems they are not good candidates to be handling your HOA funds.

Do not allow the HOA property manager to have exclusive access to bank accounts and checks. If your by-laws require yearly audits, demand they be done!

Do not allow cash payments to be made to the HOA for any reason.

Do not give the HOA president carte blanche to spend thousands of dollars without board approval. A $1,000 limit should be sufficient.

If the HOA operations have been “shaky” and you manage to land a position on the board, insist on a forensic audit during a board meeting and double check to be sure it was recorded in the minutes. If you are a homeowner, submit a written request for a forensic audit. Retain a copy of your request.

If your by-laws allow for more than 5% of your annual budget to be spent by a property manager without board approval, suggest a change to the by-laws. It would be most beneficial to require a vote by the homeowners for any spending that will exceed 5% of the annual budget.

Regarding audits: The statement has been made on many occasions that honest board members don’t need audits. I strongly disagree. Audits work both ways; keeping thieves from stealing from an easy target and protecting honest people from being accused of stealing.

Never forget that people who have nothing to hide, hide nothing!
