Fireworks in Carson City, Nevada

This is shameful.

No state in the union has suffered more from HOA abuse than homeowners in Nevada. No homeowners have been financially stripped and laid bare more than people in Nevada. Organized crime in so entrenched in Homeowners Associations in that state that many people in HOAs have lost up to 90 per in value in their homes. But when Organized Crime sees a chance to put OPM (other peoples money) into their pockets, there’s not much that will hold them back.

But ripped-off homeowners in that state were finally able to convince the U.S. Attorney and the FBI to do an investigation, and 39 people including police officials, attorneys, businessmen, political figures, a well-known TV star were indicted and now face felony trials for theft and official corruption. Well, I’ll modify that, a bit. In typical Nevada fashion, certain key suspects began killing themselves in strangely concocted ‘suicides’, and others began to rat out the bigwigs, eight or nine of whom still face trial for their crimes.

Nevada citizens were even able to get a couple of homeowners advocates placed in key positions on the eminently corrupt Nevada Real Estate Division. These homeowners rights advocates tried to get NRED to respect such Constitutional ‘novelties’ as Due Process, a well-recognized Constitutional Right which protects all the people from government abuse.

Tomorrow and Thursday day is when well-reimbursed stooges on the Division of Real Estate tries to crush that right forever. It’s happening in Carson City. And the largest CAI vultures ever spotted by bird watchers are flying the skies over the state capitol right now making sure their paid minions succeed at stifling any sort of free speech or respect for law and order. Nevada is well known for its deep layers of official corruption. By the end of this week you’ll know whether it’ll be business as usual, or whether those struggling under the weight of oppression can reserve for the people a tiny hope for fairness.

 

HOA Hall Of Shame Targets Forest Hills

Homeowners in Las Vegas are some of the fortunate few in the country who can monitor the behavior of their HOA boards. But it wouldn’t happen without Darcy Spears, creator of the HOA Hall of Shame report. There’s never a lack of misbehavior among Nevada Homeowners Associations to report on.

The latest is in the Forest Hills Homeowners Association where homeowners have often found their water shut off because of collapsed water pipes. Complain to a board member and they refer you to the management company, H&L Realty, which either refers you back to the board or hangs up on you. If you want that morning shower you have to find a contractor and pay for all the damage yourself. Of course, you have to keep paying those high HOA dues which theoretically are supposed to pay for basic maintenance.

It’s just another in a long, long list of reasons to discard the current HOA system.

Listen, As Never Before!

On American Independence Day 2014, is it time to implement “Equal Justice Under The Laws” For HOA & Condo Owners?” Are legislatures willfully violating our citizen rights? If so, why?

Are the following not true?

– Federal Laws require all states to comply with the US Constitution as the Supreme Law of the Land.

– States are required to support and defend the US Constitution when passing statutes and implementing regulations.

– States, counties and cities are required to support and defend the US Constitution in their statutes, regulations, rules, codes, etc. that bind all citizens.

– Local government rules, regulations, codes, etc. establish the controlling concepts and limitations in CC&Rs for when, how and by whom Homeowner and Condo Associations are established, maintained and how the property owners are governed in addition to standard government restrictions.

– So, why can the state and local government authorities legally allow developers to implement CC&Rs that violate the Constitutional rights and protections of HOA and Condo property owners? Is this not morally deficient, if not exactly illegal?

– Is this not a clear case where the government is violating its own agreements and mandates to “EQUALLY” support and defend the Supreme Law of this Land for all citizens?

– Does claiming that because HOAs and Condos are created as special, quasi-governmental corporations there is no moral or legal obligation to protect all citizens equally under our Supreme Laws stand up to even plain old common sense arguments?

– How can state government authorities, on one hand, rigidly control the creation of property and the associated governance regulations and rules of HOAs and Condos; but, on the other hand, (much like the Pontius Pilate of the Bible) ignore the fact that they are directly aiding and abetting the conscious denial of equal justice under the laws for HOA and Condo owners?

On American Independence Day, please explain why such crass injustice can be tolerated and ignored by so many in this industry?

Why won’t every single one of you Americans reading this topic stand up and demand “equal justice under our laws” for HOA and Condo owners?

Time was, you couldn’t get a journalist anywhere to listen to your rants about crooked HOAs. Calling the local TV station or newspaper was a loser’s game. The average person just didn’t have the clout to get a story out there.

Well, Ladies and Gentlemen, welcome to the Internet. Traditional media used to spit and hiss when they thought of all those “pajama-clad bloggers” out there mucking up the sewer pipes of information distribution. Now those journalists who wouldn’t listen to the hoi paloi are spitting into the wind as we just blow them away like so much dry chaff. Now, more people are reading websites like ours than are reading many big-city newspapers.

Pity the Boss Man

You know, you’ve gotta start feeling a little sorry for Las Vegas crime boss Leon Benzer right about now. Gosh, dang! Another four of his co-conspirators have now pleaded  guilty to charges of racketeering and conspiring to steal massive amounts of money from Las Vegas homeowners. But Bobo Benzer hasn’t been able to keep his organized crime mob together. Gone are the days when a spaghetti-eating garlic-spitter could fire a .32 shell into the face of an adversary to shut him up. These days, you just can’t get good help.

Benzer is now just one of a tiny handful of crooks still accused of decimating Homeowners Associations in the Valley by putting ‘straw men’ into office as HOA board members and voting to divert millions of dollars in insurance mitigation work to his minions of willing wonks. (Actually, I was going to say ‘Wops’ but thought better of it. Besides, his name is Benzer, not Benzini). Sure, the first handful of people fingered in the HOA investigation ‘committed suicide.’ But in the old days a suicide really meant something, didn’t it? Suicide was a rite of passage, an honor befitting a snitch’s snitch. One couldn’t be an effective Capo without a few suicides scattered here and there around the landscape.

But, dang! Every time a ‘suicide’ happened in the feds’ Las Vegas HOA investigation, more rats started squealing. This wasn’t just a few rodents trying to find a wooden plank, this was swarms of rats diving off the decks of the Titanic.

Yep, it must be a lonesome time for Leon Benzer. Poor Babee!
